1. About these Terms
These Terms of Service ("Terms") govern your access to and use of https://motovile.com (the "Website") and any purchase you make from Motovile ("Motovile", "we", "us" or "our"). By accessing the Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
These Terms are governed by the laws of the State of Kuwait, including Decree-Law No. 10 of 2026 Regulating Work in the Digital Commerce Sector, Law No. 39 of 2014 on Consumer Protection, and Law No. 20 of 2014 on Electronic Transactions.

3. Eligibility
To purchase from the Website, you must be at least 18 years old and able to enter into a legally binding contract under Kuwaiti law. By placing an order, you confirm that you meet these requirements and that the information you provide is accurate and complete.
4. Your account
You may need to create an account to place an order. You are responsible for keeping your login details confidential and for all activity that takes place under your account. Please notify us immediately if you suspect any unauthorised use of your account.
5. Products, descriptions and availability
We carry a large and frequently changing catalogue. We make every effort to describe and price our products accurately. However, we do not warrant that all product descriptions, images, specifications or other content are complete, current or error-free.
Product availability can change quickly. If an item you have ordered becomes unavailable, backordered or discontinued, we will contact you as soon as possible and offer suitable alternatives or a full refund for that item. In the event of any discrepancy between the information shown online and the information available in-store, the in-store information shall prevail.
6. Orders and contract formation
When you place an order, you are making an offer to purchase. Your order is accepted, and a binding contract is formed, only when we confirm dispatch of your order or otherwise notify you of acceptance. We reserve the right to decline or cancel any order, including where:
- the product is unavailable or incorrectly priced;
- we are unable to verify your payment or delivery details; or
- we reasonably suspect fraud or a breach of these Terms.
If we cancel an order for which you have already paid, we will issue a full refund for the cancelled items.
7. Pricing and electronic invoicing
All prices are displayed in Kuwaiti Dinar (KWD). The total price payable, including any applicable delivery fee, is shown to you before you confirm and pay. We do not add undisclosed charges after checkout.
Immediately upon conclusion of your purchase, we will issue an electronic invoice in Arabic (and may provide it in other languages alongside Arabic), setting out the product or service, the total price including all fees, the delivery date and location, and the payment method used, as required by law.
8. Pricing errors
Despite our best efforts, occasional pricing errors may occur. Where a product is listed at an incorrect price, we are not obliged to supply it at that price. We reserve the right to cancel any order affected by a genuine pricing error, even after order confirmation, and will issue a full refund where payment has been made.
9. Payment
We accept KNET, major credit and debit cards, and Apple Pay. All payments are processed through secure, encrypted payment providers that comply with Central Bank of Kuwait regulations. We do not impose additional fees on you for using electronic payment methods. We do not store full card details on our systems.
10. Shipping and returns
Delivery of your order is governed by our Shipping & Delivery Policy, and your rights to return products and receive refunds are governed by our Returns & Refund Policy. Both policies form part of these Terms.
11. Warranties and consumer rights
Nothing in these Terms excludes, restricts or modifies any right or remedy you have as a consumer under Kuwaiti law that cannot lawfully be excluded, restricted or modified. Any provision that attempts to do so is void to that extent. Where products carry a manufacturer's warranty, the terms of that warranty apply in addition to your statutory rights.
12. Intellectual property
All content on the Website — including text, graphics, logos, images, product descriptions and software — is owned by or licensed to Motovile and is protected by applicable intellectual property laws. You may use the Website for your own personal, non-commercial use only. You may not copy, reproduce, republish, distribute, sell or commercially exploit any content from the Website without our prior written permission. Brand names and trademarks of manufacturers remain the property of their respective owners.
13. Acceptable use
You agree not to use the Website:
- in any way that breaches applicable law or regulation;
- to transmit unlawful, defamatory, infringing or harmful content;
- to introduce malware or attempt to gain unauthorised access to our systems;
- to interfere with the security or proper functioning of the Website; or
- for any fraudulent or deceptive purpose.
We may suspend or restrict access to the Website, or cancel orders, where we reasonably believe these Terms have been breached.
14. Reviews and user content
If you submit reviews, comments or other content, you confirm that it is your own, lawful, and does not infringe the rights of others. You grant us a non-exclusive, royalty-free licence to use, display and reproduce that content in connection with our business. We may remove any content we consider inappropriate, offensive or unlawful.
15. Third-party links
The Website may contain links to third-party websites. We do not control and are not responsible for the content, products or privacy practices of those websites. Accessing them is at your own risk.
16. Limitation of liability
To the maximum extent permitted by Kuwaiti law, and subject always to Section 11, Motovile shall not be liable for indirect, incidental or consequential loss arising from your use of the Website. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under Kuwaiti law. Our total liability in respect of any order shall not exceed the amount you paid for that order, except where the law provides otherwise.
17. Force majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, extreme weather, strikes, failures of couriers or payment networks, or government action.
18. Privacy
Our collection and use of your personal data is governed by our Privacy Policy, which forms part of these Terms.
19. Governing law and disputes
These Terms are governed by, and construed in accordance with, the laws of the State of Kuwait. We aim to resolve any dispute with you directly and fairly. Where a dispute cannot be resolved, it may be referred to the Digital Commerce Dispute Settlement Committee at the Ministry of Commerce and Industry, or to the competent courts of the State of Kuwait.
20. Changes to these Terms
We may update these Terms from time to time. The current version will always be posted on the Website with an updated "Last updated" date. Your continued use of the Website after changes take effect constitutes acceptance of the revised Terms.
21. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
